Terms of service

Worx Wireless Affordable Connectivity Program Terms and Conditions

These Terms and Conditions govern your participation in the Affordable Connectivity Program (ACP), and includes required disclosures and eligibility information. Our standard terms and conditions, including the Acceptable Use Policy (AUP), also apply. In the event the ACP Terms and Conditions and the standard terms and conditions conflict, the ACP Terms and Conditions control. If you have additional questions, email us at terms@worxwireless.com . Worx Wireless is a service of Worx Wireless LLC.

The ACP is a government benefit program operated by the Federal Communications Commission (FCC) that provides discounts on monthly broadband Internet access service. The ACP provides discounts of up to $30 per eligible household on monthly broadband Internet access service (or up to $75 per eligible household on Tribal lands). Eligible households can also receive a one-time discount of up to $100 to purchase a laptop, desktop computer, or tablet from participating providers if they contribute more than $10 and less than $50 toward the purchase price. The ACP monthly service discount cannot be transferred to another household or individual. An eligible household is limited to one monthly service discount and a single, one-time device discount per household. ACP benefits may be obtained from any participating provider, and your monthly service benefit may be transferred to another provider subject to regulatory restrictions. ACP service is subject to consumer eligibility, provider participation, product availability, and the FCC/Universal Service Administrative Company (USAC) approval. The ACP was launched on December 31, 2021, and replaced the Emergency Broadband Benefit (EBB) program. Complaints may be directed to us at service@worxwireless.com. Unresolved questions or complaints may be directed to the FCC’s Consumer Complaint Center.

By applying for or subscribing to Worx Wireless’s ACP-supported services, you authorize Worx Wireless and its contracted partners, for the purpose of applying for, determining eligibility, enrolling in and seeking reimbursement of ACP service and device benefits, to collect, use, share and retain your personal information, including, but not limited to, information required for establishing eligibility for and enrolling in the Lifeline program, and including, but not limited to, full name, full residential address, date of birth, last four digits of social security number, telephone number, eligibility criteria, and status, the date on which the ACP service discount was initiated and, if applicable, terminated, ACP connected device distribution date/type/make and model/status, usage status and other compliance requirements, the amount of support being sought for the service and/or connected device, and information necessary to establish identity and verifiable address. This includes sharing the information with USAC and the FCC to ensure proper administration of the ACP service and connected device benefits. Failure to provide consent will result in your being denied the ACP benefits.

If you or any member of your family unit receives ACP service benefits from any other broadband provider, you consent to have your benefit transferred to Worx Wireless when you apply for and enroll in ACP services with Worx Wireless.  The effect of an ACP benefit transfer is that your ACP benefit will be applied to Worx Wireless’s ACP service and will no longer be applied to service from your former ACP service provider. You may be subject to your former ACP provider’s undiscounted rates due to the transfer if you elect to maintain service from that provider.  ACP rules limit you to one ACP benefit transfer transaction per service month. There are limited exceptions when a subscriber seeks to reverse an unauthorized benefit transfer or cannot receive service from a specific provider.

You agree that any state, local, Tribal government, school, or school district may share information about your receipt of benefits that would establish eligibility for the ACP and that such information will be used only to determine ACP eligibility.

You agree that Worx Wireless and its contracted partners may contact you to validate your eligibility for or desire to participate in Worx Wireless’s ACP offers and other products and services via email, telephone, or text messaging. Text messaging and data rates may apply. Consent for calls and texts is optional and can be revoked at any time.

ACP Eligibility and Application Process

A household is eligible to receive an ACP discount if a member of the household meets one of the criteria below:

  • Has an income that is at or below 200% of the Federal Poverty Guidelines for a household of that size;

  • Receives benefits from specific federal assistance programs: Medicaid, Supplemental Nutrition Assistance Program (SNAP), Supplemental Security Income, Federal Public Housing Assistance, Veterans and Survivors Pension Benefit, Special Supplemental Nutritional Program for Women, Infants and Children (WIC) Program, or Lifeline;

  • Is approved to receive benefits under the free and reduced-price school lunch program or the school breakfast program;

  • Received a Federal Pell Grant during the current award year; or

  • Meets the eligibility criteria for a participating provider’s qualifying low-income program.

Households on Tribal lands are additionally eligible to receive an ACP discount if a member of the household meets one of the criteria below:

  • Receives Bureau of Indian Affairs General Assistance;

  • Participates in Head Start (only households meeting the income qualifying standard);

  • Receives Tribal Temporary Assistance for Needy Families (Tribal TANF); or

  • Participates in the Food Distribution Program on Indian Reservations.

The USAC’s National Verifier and National Lifeline Accountability Database will determine ACP eligibility for the FCC.

New applicants must complete ACP application and certification forms. They may need to provide supporting documentation to verify eligibility, identity, address, and compliance with the ACP’s one-per-household benefit limit.

ACP Service Plans

You can apply your ACP discount to any available Worx Wireless service plan, including those that can be obtained with no co-pay after the application of the ACP benefit. Your service plan terms and conditions may limit the amount of high-speed data included with your service plan and the actual speeds you will achieve while using our broadband services. Other factors, including your device, network availability from our underlying carrier, your proximity to cellular towers, and environmental factors, may affect speeds.

ACP Account Activation and Activity Requirements

You must activate your service by placing an outbound call or sending a text (if your device is capable), using data, confirming that you want to activate your service will activate the Worx Wireless ACP service, or by other means we communicate to you. To continue receiving your ACP service with Worx Wireless, you must make or answer a voice call or send a text message (if your device is capable), use data, purchase minutes, or respond to direct contact from Worx Wireless at least once during any 30-day period.

Maintaining ACP Eligibility and Service

You will receive ACP service from Worx Wireless if you continually meet the ACP eligibility requirements and the program remains active. If Worx Wireless believes you are not eligible for ACP service, we will notify you that your ACP service will be canceled and that you will be de-enrolled from the program. You will have 30 days to respond to the termination notice. If you do not demonstrate continued eligibility, you will be de-enrolled from the ACP, and your service will be canceled; you will lose any remaining services and will no longer receive service. If you no longer qualify for the ACP discount, you must notify Worx Wireless within thirty (30) days of this fact to be removed from the program.

ACP Discontinuance

Suppose the FCC announces that funding for the ACP has been exhausted. In that case, we discontinue our ACP service offers, or we determine you are no longer eligible for the ACP, we will notify you, and you will revert to our standard FREE Lifeline plan where available and if you are eligible. You also may choose to keep your service plan or choose another plan available at the time, but you will be subject to paying applicable rates applicable plus applicable fees and taxes. Our standard terms and conditions will apply.

ACCOUNT ACTIVITY REQUIREMENT

To continue receiving your Lifeline and/or ACP service with Worx Wireless, FCC regulations require that, unless a subscriber has a regular billing and payment relationship with us, the subscriber must use the service at least once every 30 days. Subscribers can “use” the Services by (1) completing an outbound call, sending a text message, or using data; (2) purchasing minutes or data from WORX Wireless to add to the subscriber’s service plan; (3) answering an incoming call from a party other than Worx Wireless; or (4) responding to direct contact from Worx Wireless and confirming that the subscriber wants to continue with program benefits. At or before 30 days of non-use, subscribers will receive notice that failure to use the services within a 15-day notice period will result in de-enrollment. If a subscriber does not respond to the notice or use the service before the end of the 15-day notice period, Worx Wireless is required to and will de-enroll the subscriber from services. The subscriber will still be able to use the device associated with the services to contact 911 emergency services, provided it is charged and can connect to a wireless network.

ACTIVATING AND USING YOUR WORX WIRELESS COMMUNICATIONS SERVICE/TELEPHONE NUMBER

A Worx Wireless Device should arrive to you in a pre-activated or “hotlined” status.  Activation may require a call to 611 to complete full activation.  When you receive a Worx Wireless telephone number is assigned to your Worx Wireless Device. However, you will acquire no proprietary interest in any number assigned to you.  This number is “owned” by the underlying carrier, and ownership will remain with the underlying carrier during the time of Service.  This number can be ported to any carrier of choice as long as the number remains active throughout the completion of the port.  Should the telephone number be disconnected, it is immediately released to the underlying carrier network and cannot be re-attained by Worx Wireless, even upon your request and immediate reactivation by the company. The wireless telecommunications networks used to transmit calls for the Service are owned and operated by various licensed commercial mobile radio service providers ("underlying carriers"), not Worx Wireless. Your Device can only be used through Worx Wireless and cannot be activated with any other wireless or cellular service except where allowable by law. Worx Wireless Services are provided at Worx Wireless’ discretion.  You may port your existing telephone number to Worx Wireless’ carrier network.  Worx Wireless is not responsible for any “termination fees” that may be imposed by another carrier that ports its number to the Worx Wireless platform.

INTERNATIONAL CALLS

Currently, the International call feature is blocked by Worx Wireless and its underlying carrier. If you successfully access an International Long Distance number, additional charges will incur on your account. International calling rates vary by country. You may call 611 if you have a specific inquiry and speak with a customer service representative.

Any charges you incur due to attempts to access this feature from a Worx Wireless Device are non-refundable.  Voice minute deductions for international calls begin when the International Long Distance ("ILD") access number is dialed and may apply to dropped calls, misdialed numbers, and busy destination numbers. You may experience connection failures more frequently than calls made within the United States when making international calls. Worx Wireless will not credit voice minutes deducted for unsuccessful calls. You will not be able to make or receive calls on your Worx Wireless Device when you are located outside of the United States, Puerto Rico, or the U.S. Virgin Islands.

WORX WIRELESS SERVICE AND USAGE

Voice and Text Usage Charges. Voice minutes will be deducted for all time during which your Worx Wireless Service is connected to, or using, the wireless system of any underlying carrier.  Use of a wireless system typically begins when you press the "send", "call," or another button to initiate or answer a call and does not end until you press the "end" button or the call is otherwise terminated.  Voice minutes are deducted for all incoming and outgoing calls, including calls to toll-free numbers and calls to access your voicemail (voice minutes will be deducted for each call separately).  Voice minutes for Three-Way calls may be deducted at twice the incremental rate.  Voice minutes are NOT deducted for calls to 911, 611, or the 800# for Worx Wireless Customer Service.  You may be charged voice minutes for outbound calls for incomplete and/or busy-no-answer calls. (Although this is unlikely, Worx Wireless cannot dispute these charges and cannot refund deducted minutes on an incomplete or busy no-answer call.)  Voice minutes are deducted in full unit increments; partial minutes are rounded up to the next minute.   No credit is given for dropped calls. Except where otherwise noted (e.g., text messages to and from Worx Wireless or unlimited plans), text messages will be billed for each incoming and outgoing text message. If you subscribe to a plan that includes federal Lifeline-supported voice service, incoming and outgoing text messages will not be billed against your voice minutes.

Calls to 900/976 or other pay-per-call Service numbers are unavailable to Worx Wireless subscribers. Worx Wireless will block any calls to 1-900, 1-976, some international calling, or other pay-per-call Services.  However, if any charges are received by Worx Wireless from the underlying carrier for these types of calls, these charges will be passed thru to the end user for payment. When billed to you, non-payment of these charges will constitute automatic disconnection of Service.

Calls placed to 800/866/877 or other toll-free numbers will incur standard minute usage of a 1:1 ratio.  Worx Wireless allows you to make or receive domestic long-distance calls inside the domestic USA as long as coverage is available.

Data Usage.  Call data transport is billed in fullkilobyte increments, and actual transport is rounded up to the next whole kilobyte increment at the end of each data session for charging purposes. Worx Wireless charges a full kilobyte of data transport for every fraction of the last kilobyte of data transport used on each data session. Network overhead, software update requests, and resend requests caused by network errors can increase measured kilobytes. DATA TRANSPORT/USAGE OCCURS WHENEVER YOUR DEVICE IS CONNECTED TO OUR NETWORK AND IS ENGAGED IN ANY DATA TRANSMISSION, INCLUDING BUT NOT LIMITED TO: (i) SENDING OR RECEIVING EMAIL, DOCUMENTS, OR OTHER CONTENT, (ii) ACCESSING WEBSITES, OR (iii) DOWNLOADING AND USING APPLICATIONS. SOME APPLICATIONS, CONTENT, PROGRAMS, AND SOFTWARE THAT YOU DOWNLOAD OR THAT COME PRE-LOADED ON YOUR DEVICE AUTOMATICALLY AND REGULARLY SEND AND RECEIVE DATA TRANSMISSIONS TO FUNCTION PROPERLY WITHOUT YOU AFFIRMATIVELY INITIATING THE REQUEST AND WITHOUT YOUR KNOWLEDGE. FOR EXAMPLE, APPLICATIONS THAT PROVIDE REAL-TIME INFORMATION AND LOCATION-BASED APPLICATIONS CONNECT TO OUR NETWORK AND SEND AND RECEIVE UPDATED INFORMATION SO THAT IT IS AVAILABLE TO YOU WHEN YOU WANT TO ACCESS IT. IN ADDITION, ANY ADVERTISEMENTS OR ADVERTISER-RELATED MESSAGES OR DATA DELIVERED TO YOUR DEVICE, EVEN IF DELIVERED TO AN APPLICATION, AS WELL AS ANY MESSAGES OR CONTENT THAT INITIATE IN RESPONSE TO AN ADVERTISEMENT, WILL COUNT TOWARD YOUR DATA USAGE. YOU WILL BE BILLED FOR ALL DATA TRANSPORT AND USAGE WHEN YOUR DEVICE IS CONNECTED TO OUR NETWORK, INCLUDING THAT WHICH YOU AFFIRMATIVELY INITIATE OR THAT WHICH RUNS AUTOMATICALLY IN THE BACKGROUND WITHOUT YOUR KNOWLEDGE, AND WHETHER SUCCESSFUL OR NOT. A DATA SESSION INITIATED ON THE UNDERLYING CARRIER NETWORK WILL CONTINUE ITS CONNECTION OVER THE UNDERLYING CARRIER NETWORK UNTIL THE DATA TRANSMISSION IS CONCLUDED, EVEN WHEN YOU CONNECT TO A WI-FI NETWORK DURING THE TRANSMISSION.

Worx Wireless Service is provided at the company’s discretion. Worx Wireless may change pricing or the company’s Terms and Conditions of Service, from time to time, without notice, unless expressly prohibited by law.   Worx Wireless will notify you of changes to the Terms and Conditions of Service that are determined to be materially adverse to your Service 30 days in advance of the change. Any changes or modifications to these Terms and Conditions of Service will be binding upon you once they are available on the Worx Wireless website at www.WorxWireless.com. If you do not terminate Service within 30 days of receiving this notice of a change in the Terms and Conditions of Service, you agree to accept any such changes.  Your right to use Worx Wireless Service is subject to the Company’s business practices, policies, procedures, rates, and Terms and Conditions of Service.  Worx Wireless reserves the right to modify or cancel your Service account or take corrective action at any time and for any reason, including, but not limited to, violating any provision of these Terms and Conditions of Service.

DATA SPEEDS ARE NOT GUARANTEED. Worx Wireless does not guarantee the speed of the data service it provides. Data speeds depend on many factors, including reception, tower traffic, your device’s capabilities, etc. Worx Wireless reserves the right to prioritize your data behind other Worx Wireless customers during network congestion or high individual daily usage by throttling your data speed. Reduced speeds and increased latency may cause websites to load more slowly or affect the performance of data-heavy activities such as video streaming or interactive gaming.

Throttling: Worx Wireless may offer plans with data at throttled speeds. After any high-speed data allotment is used, speeds will be reduced to 256 kbps-equivalent until the end of your billing cycle. Subscribers that consume an additional 20GB of data at 256kbps speed will be further throttled down to 125kbps until the end of your billing cycle. You can upgrade your plan at any time to a plan with a higher high-speed data allotment, or you can add a data top-up to your account at any time, the included allotment of which will be available until used or for 30 days from the date of purchase, whichever comes first. Customers may notice changes in the performance of specific applications when they are on throttled usage. You are responsible for all data activity to and from your device, regardless of who initiates the activity. Some tips for conserving your data usage: (1) Use WiFi whenever possible; (2) Download music to the device for offline use and avoid music streaming services like Pandora when not on WiFi; (3) Only stream video like YouTube and Netflix when on WiFi. Otherwise, you can download the video to your device while on WiFi for later offline viewing.

VOICE AND TEXT PERMISSIBLE USAGE

WORX Wireless voice and text Services, including unlimited voice and/or text messaging plans, are solely for live dialogue between and initiated by two individuals for personal use only and may not be used for any other purposes, including, but not limited to machine-to-machine, monitoring Services, transmission of broadcasts or recorded material, telemarketing, call center Services, auto-dialed calls or texts, other commercial uses, or other connections that do not consist of uninterrupted live dialogue between individuals. These and other uses have the potential to disrupt reliable Service to other customers and/or have a disproportionate impact on network resources and therefore are not permitted. We may determine at our sole discretion that non-permissible usage is taking place and reserve the right to respond by, without notice or limitation, implementing limits, adding voice or text monthly usage caps, placing you on a limited plan, or, at our sole discretion, terminating your Service.

DATA PERMISSIBLE USES

Our data or messaging features are provided solely for non-commercial messaging, Internet browsing, e-mail access, and non-continuous data streaming (e.g., downloading files). Depending on your rate plan, your data usage may be metered by Worx Wireless. Smaller data plans are available. While our data and messaging features permit the most common uses, there are specific uses that cause extreme network capacity issues and are therefore prohibited. Our data and messaging Services may not be used: (a) to generate excessive amounts of Internet traffic through the continuous, unattended streaming, downloading, or uploading of videos or other files, (b) to operate hosting Services including but not limited to, web or game hosting, (c) to maintain continuous active network connections to the Internet such as through a web camera or automated machine-to-machine connection or peer-to-peer (P2P) file sharing, (d) to disrupt e-mail use by others using automated or manual routines, including, but not limited to "auto-responders" or cancel bots or other similar routines, (e) to transmit or facilitate any unsolicited or unauthorized advertising, telemarketing, promotional materials, “spam,” “junk mail,” unsolicited commercial or bulk e-mail or messaging, (f) for activities adversely affecting the ability of other people or systems to use either WORX wireless Services or other parties' Internet-based resources, including, but not limited to, "denial of Service" (DoS) attacks against another network host or individual user, (g) for an activity that tethers or connects any device to personal computers or other equipment for the purpose of transmitting wireless data over the network (unless you are using a plan designated for such usage), (h) as a dedicated data connection, (i) for abnormally long data transmissions, or (j) for any other reason that, in our sole discretion, violates our policy of providing “unlimited” Services for non-commercial use.

ACCOUNT BALANCES

Your Worx Wireless Device will only operate when you have minutes, texts, or broadband data available on the Device. (This does not apply to 911 calls. These calls will go through on any device regardless of activity and the availability of voice minutes.)  Each prepaid Service package comes with a number of minutes, texts and/or data and a Service period that begins to run from the day you add minutes, texts, and/or data to your Device. Worx Wireless minutes, texts or broadband data added to your Device will expire with active Service and Usage during a consecutive thirty (30) day period.   To keep your account active and to avoid Service interruption, you must either maintain a positive account balance at all times or pay any applicable subscription charges, depending on your Service plan. Account balances are not transferable, redeemable for cash, or refundable.

BILLING & COLLECTION

You are responsible for paying all charges for or resulting from Services provided under this Agreement, less any subsidies you are eligible for. Charges may include, without limitation: voice minutes, data usage, roaming, recurring monthly Service, activation, administrative, returnedcheck and late payment charges; network and other surcharges; optional feature charges; directory assistance charges; any other charges or calls charged to your phone number; and applicable taxes, surcharges and governmental fees, whether assessed directly upon you or Worx Wireless. Worx Wireless may add its own charges to those charged by third parties. Payment for all charges is made in advance, and such charges are not prorated.

Worx Wireless will send an invoice via text message to you monthly, notifying you of the amount due, including past due, and the due date.

If you do not pay for your monthly Service and you are a non-ACP customer, Worx Wireless will not renew your minutes on the next month’s plan.

Worx Wireless will use to debit the amount owed on your account each month as long as your Service remains active.  You may also opt to deposit payment for Service for one or more months in advance. Should you choose to no longer avail yourself of this option or to terminate your Service with Worx Wireless, you will receive a refund of any unused advance deposit payments upon the occurrence of that event.

If you are disconnected from Worx Wireless’ platform owing a balance, that balance will be written off as uncollected funds. Worx Wireless will not continue to seek payment on the balance.  A new account will be created if you want to return to Worx Wireless. For ACP’s customers, this would mean showing proof of eligibility for Lifeline Service.

Dishonored Checks and Other Instruments.  We will charge you $30.00, or the highest amount allowed by law, whichever is less, for any check or other instrument (including any credit card chargebacks) tendered by you and returned unpaid by a financial institution for any reason. You agree to reimburse us the fees of any collection agency, which may be based on a percentage at a maximum of 33% of the debt, and all costs and expenses, including reasonable attorneys’ fees, we incur in such collection efforts or the most allowed by law, whichever is less.

ADDITIONAL SURCHARGES

Currently, Worx Wireless and its underlying carrier block call forwarding and roaming features. If you successfully access these features (not authorized by Worx Wireless), you will incur additional charges of $0.06 per minute. International roaming rates vary by country. Any charges you may incur due to any attempts to access these features from your Worx Wireless Device are non-refundable.

DEVICE OFFERINGS AND DEVICE REQUIREMENTS

Except where you bring your own Device to Worx Wireless, Devices provided to you are selected at the sole discretion of the company provider.  WorxWireless’s Devices comply with the Federal Communications Commission’s (“FCC’s”) rules and are Wi-Fi-enabled.  As FCC rules require, some of Worx Wireless’s Devices are hotspot enabled.  Worx Wireless devices will follow the phase-in requirement listed in the order relating to the percentage of devices offered with or without charge for use with a hotspot-capable mobile broadband service (or capable of “tethering”). Subscribers will also have the option to purchase upgraded smartphones. Worx Wireless’ policies regarding device upgrades and replacements are available on the Company’s website.

LOCATION-BASED SERVICES

Your Device may be locationenabled, meaning that the Device is capable of using optional Goods, Content, and Services, at your request or the request of a user on your account, offered by Worx Wireless or third parties that make use of a user’s location (“LocationBased Services”), using location technology such as Global Positioning Satellite (“GPS”), wireless network location, or other location technology. Please review the terms and conditions and the associated privacy policy for each LocationBased Service to learn how the location information will be used and protected. We may also use location information to create aggregate data, subject to our Privacy Policy, for services like trafficmonitoring and delivering targeted advertising. It is your responsibility to notify users on your account that the Device they are using may be locationenabled. Certain LocationBased Services or the disclosure of location information may be restricted by the use of parental controls or similar features. Visit our website to learn more.

DEVICE LOCKING/UNLOCKING POLICY

Worx Wireless provides unlocked devices, but if this policy were to change, Worx Wireless would comply with point 12 of the CTIA consumer code. You can “bring your own device” (BYOD) as long as your phone is compatible with the underlying carrier Network. Similarly, you can activate your Worx Wireless device to another carrier on a similar CDMA or GSM network.  We may periodically remotely upgrade the firmware or software on your Device.

UNAUTHORIZED DEVICE TAMPERING

The Worx Wireless Device is exclusively for use by you with the prepaid wireless Service available solely in the United States, Puerto Rico and the U.S. Virgin Islands. Any other use of your Worx Wireless Device, including, without limitation, any resale, unlocking and/or re-flashing of the Device, is unauthorized and constitutes a violation of your agreement with Worx Wireless. You agree not to unlock, re-flash, tamper with, or alter your Worx Wireless Device or its software, enter unauthorized PIN numbers, engage in any other unauthorized or illegal use of your Worx Wireless Device or the Service, or assist others in such acts, or to sell and/or export Worx Wireless Devices outside of the United States. These acts violate Worx Wireless's rights and state and federal laws. Improper, illegal, or unauthorized use of your Worx Wireless Device is a violation of this agreement and may result in immediate discontinuation of Service and legal action.  Worx Wireless will prosecute violators to the full extent of the law. You agree that any violation of this agreement through your improper, illegal, or unauthorized use shall entitle Worx Wireless to recover liquidated damages from you in an amount not less than $5,000 per Device purchased, sold, acquired, or used in violation of this agreement.
